Tagg’s Terms and Conditions

Please read these Terms and Conditions carefully before using the Tagg App operated by Primetag, S.A., a Portuguese limited liability company by shares registered under Portuguese law, with registered office at PCI – Parque de Ciência e Inovação, Edifício Central, Via do Conhecimento, 3830-352 Ílhavo, and holder of tax identification number 513 251 405.
1 Definitions
“Terms and Conditions” means the terms and conditions outlined under this document for the use of the Tagg App.
“Tagg App” means the software application provided by Primetag and downloaded by you on any compatible device.
“Service” means all Tagg App features, technologies and software.
“Account” means a unique account created for and by you to access the Tagg App.
“Personal Data” means, in accordance with article 4(1) of the European Union’s General Data Protection Regulation, any information relating to an identified or identifiable natural person.
“Primetag” means Primetag, S.A., a portuguese limited liability company by shares registered under Portuguese law, with registered office at PCI – Parque de Ciência e Inovação, Edifício Central, Via do Conhecimento, 3830-352 Ílhavo, and holder of tax identification number 513 251 405.
2 Conditions of use
The use of the Tagg App is governed by these Terms and Conditions.
These Terms and Conditions set out the rights and obligations of all users of the Tagg App. If you do not agree with these Terms and Conditions, you will not be able to create an Account and, therefore, you will not be able to use the Tagg App.
By creating an Account in the Tagg App, you certify that you have read and accepted these Terms and Conditions. You represent that you are 13 years of age or older. Use of the Tagg App is not permitted to people younger than 13 years of age.
You hereby acknowledge that you shall not use the Tagg App for unlawful or criminal activities and related activities.
3 Privacy policy
The creation of an Account and the use of the Tagg App is subject to the acceptance of the Privacy Policy.
The Privacy Policy describes Primetag’s policies and procedures on the processing of Personal Data related to the use of the Tagg App.
4 Account
For purposes of the creation of an Account under the Tagg App, you shall provide accurate, complete and current information.
The following information is requested to create an Account under the Tagg App:
- a) Email address;
- b) Name;
- c) Age;
- d) Gender;
- e) City; and
- f) Password.
You shall be responsible for all activities that occur under your Account.
You may not share your Account with any third parties. Your Account username is non transferable and your Account password is confidential.
You may not use the name of another person or entity or use a name that is not lawfully available for use as your username. Primetag shall not be liable for any damage arising from use of a name you are not entitled to use.
5 Content
The Tagg App does not allow users to post any sort of content.
Content available under the Tagg App is publicly accessible under other platforms. Primetag may not be held liable for any unlawful content that may be accessible under the Tagg App.
You may view and organize content using the Tagg App. You acknowledge that you do not have any copyrights or any other right over the content available under the Tagg App.
You grant Primetag a perpetual, royalty-free, worldwide and non-exclusive license to display, use, copy, transmit and broadcast the organization of content you may create using the Tagg App.
Primetag does not guarantee there will be no loss or corruption of content. Corrupt or invalid backup points may occur. Primetag may not be held liable for any loss of integrity of content or content organization or for the completeness and accuracy of the information displayed.
6 Intellectual Property
Excluding content and content organization, Primetag is the owner of all materials, products and services provided under the Tagg App, including all copyright, trademark, trade secrets, patents and other intellectual property rights related to the Tagg App. You shall not reproduce or redistribute any intellectual property made available under the Tagg App.
Primetag hereby grants you a non-exclusive, worldwide and perpetual license to perform, display and use the Tagg App and the Service.
7 Price
The Tagg App is free to use.
8 Termination
Primetag may suspend or terminate Accounts immediately, without prior notice or liability, pursuant to the performance of any breach of these Terms and Conditions.
Upon termination, the Account will be deactivated and access to the Tagg App will cease immediately.
Primetag may also terminate Accounts and the provision of its Services at any time and at its sole discretion provided it gives reasonable prior notice, which shall be no less than 15 calendar days.
You may, at any time, request for your Account to be immediately deactivated or to simply stop using your Account.
9 Limitation of liability
Primetag shall not be liable for any damages that may occur to you as a result of your misuse of the Tagg App.
10 “As is” and “as available”
The Tagg App is made available “as is” and “as available” and with all faults and defects without warranty of any kind. Primetag provides no warranty or undertaking that the Tagg App will meet your requirements, is adequate for you to achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards, be error free or that any error or defects can or will be corrected.
11 Dispute resolution
Primetag is always available to receive any concerns or dispute about the Tagg App or the Service you may have and undertakes to settle them amicably. Please use the feedback channel available under the Tagg App to submit any feedback you may have.
12 Governing law
These Terms and Conditions shall be subject to Portuguese law. Your use of the Tagg App may also be subject to other local, state, national or international laws.
13 Changes to these Terms and Conditions
Primetag reserves the right to edit, modify, change and update these Terms and Conditions at any time to reflect changes in the nature of the services provided under the Tagg App, to conform to changes in law, and for any other justifiable reason. Primetag shall give reasonable notice to you of such events through the Tagg App.
