This Privacy Policy contains information regarding:

  • Processing activities involving the personal data of users (“Users”) of the software application (“Tagg App”) provided by Primetag (as defined below);
  • Users’ rights under the General Data Protection Regulation, approved by Regulation (EU) 2016/679 of the European Parliament and of the Council (“GDPR”);
  • The use of cookies on the Tagg App.

1 What is personal data?

According to the GDPR, any information relating to an identified or identifiable natural person, such as any User, may be deemed as personal data.

2 Who processes personal data?

Users’ personal data is processed by Primetag, S.A., a portuguese limited liability company by shares registered under Portuguese law, with registered office at PCI – Parque de Ciência e Inovação, Edifício Central, Via do Conhecimento, 3830-352 Ílhavo, and holder of tax identification number 513 251 405 (“Primetag”).

As controller of the personal data processing, Primetag determines the purposes and means of the processing of Users’ personal data.

3 What personal data is processed by Primetag?

Primetag processes personal data of the following categories:

Identification data Name, gender, city, email address and age.
Data regarding Tagg App usage For example, opened hyperlinks, usage metrics, cookies and inserted data.

Under the Tagg App, Users’ personal data processed by Primetag is collected before them. Users’ personal data is never collected by resourcing to third parties or publicly accessible information.

For the avoidance of doubt, content made available under the Tagg App, which is not deemed as personal data, is provided to Users following the applicable terms and conditions of the respective source. If the author of the content does not wish to have his/her content available under the Tagg App, embedding should be disabled under the respective source’s settings. If any questions arise from embedding, creators should contact the operator of the source platform.

3.1 What about sensitive personal data?

Primetag does not process Users’ sensitive personal data. Sensitive personal data includes personal data that:

  • Reveals racial or ethnic origin;
  • Reveals political opinions;
  • Reveals religious or philosophical beliefs;
  • Reveals trade union membership;
  • Consist of genetic data;
  • Consist of biometric data for the purpose of uniquely identifying a natural person;
  • Consist of data concerning health; or
  • Consist of data concerning a natural person’s sex life or sexual orientation.

4 Which are the purposes to process Users’ personal data and the relevant lawfulness grounds?

The purposes and relevant lawfulness grounds for the processing of personal data conducted by Primetag are listed under the table below:

5 Is my personal data stored forever?

Depending on the purpose of the processing, Users’ personal data is stored for the periods listed below:

6 Does Primetag transfer personal data?

Primetag does not transfer Users’ personal data to third parties outside of the European Union.

7 What are my rights?

According to the GDPR, Users are entitled to:

  • Be informed by Primetag if their personal data is or is not processed;
  • Access their personal data and relevant information regarding processing activities performed by Primetag;
  • Request rectification or erasure of personal data or restriction of processing;
  • Oppose to the processing of personal data by Primetag;
  • Revoke their consent at any time;
  • Receive their personal data for portability purposes; and
  • Lodge a complaint before the Portuguese Data Protection Commission (Comissão Nacional de Proteção de Dados) or other competent supervisory authority. 8 Is my personal data safe?

Considering the most advanced technology, implementation costs, the nature, scope and lawfulness grounds of the processing of personal data, as well as the variable risk, probability and impact for the Users’ rights and freedoms, Primetag adopted the structural and organisational measures that ensure personal data safety standards which are adequate to face the relevant risks.

Structural and organisational measures adopted by Primetag are regularly reviewed and updated, in order to ensure their effectiveness on the safety of the processing of Users’ personal data.

9 What about cookies?

9.1 What are cookies?

Cookies are small informational archives generated by websites at the moment of access and stored on the Users’ device. Cookies allow for storage of Users’ preferences and actions on the Tagg App and are used to manage in a more efficient way Users’ requests, as well as to improve Users’ experience and to ensure the Tagg App proper functioning and safety.

Depending on the cookies used by a determined website, these may be considered as personal data, as they may include data that enables the identification of the Users, including the IP address of the device used.

9.2 Does Primetag use cookies?

Primetag does not use any cookies. Notwithstanding, websites to which the User may be redirected upon clicking on a hyperlink available under the Tagg App may use cookies. Primetag does not have any control or influence over other websites’ cookies policy and does not have access to cookies data.

9.3 Am I able to configure the use of cookies?

Users are able to change which cookies and websites are allowed on their devices, as well as delete previously stored cookies on their devices. Totally restricting the use of cookies under the devices’ configuration does not restrict access to the Tagg App, but may affect proper functioning of the latter.
